Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Eduksha mobile application or this website (together, the “Service”). By creating an account, signing in, or letting your child use a profile you created, you (the parent) agree to these Terms on behalf of yourself and your child.
1. Who can use Eduksha
- You must be a parent or legal guardian of the child whose profile you create.
- You must be at least 18 years old.
- Children use the Service only through a profile created and supervised by their parent. Children cannot independently sign up.
- By creating a child profile, you confirm that you have the authority to provide consent for that child's use of the Service under applicable law (DPDPA, GDPR-K, COPPA, etc.).
2. Your account
The Service uses your phone number for authentication via a one-time password (OTP). You are responsible for:
- Keeping your phone number, OTP, and child PIN confidential.
- All activity on your account, including activity by family members on your child profiles.
- Notifying us promptly if you suspect unauthorised access (write to hello@eduksha.in).
3. Acceptable use
You agree not to use the Service to:
- Upload content that is illegal, hateful, sexual, violent, or designed to harass another person.
- Attempt to scrape, reverse-engineer, or interfere with the Service or its underlying APIs.
- Impersonate another person or misrepresent the identity of a child.
- Use the Service to spam, send unsolicited messages, or share promotional content with other families.
- Bypass any security or rate-limiting mechanism.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Content and uploads
You retain ownership of the photos, written answers, and other material your child uploads. By uploading content, you grant Eduksha a non-exclusive, royalty-free licence to:
- Store the content in our infrastructure;
- Display it back to you and your linked family members inside the Service;
- Process it through Google Gemini for the express purpose of generating quizzes or feedback for your child.
This licence ends when you delete the content or your account. We do not use uploaded content for advertising and we do not share it with anyone outside the family group except the third-party processors listed in the Privacy Policy.
5. AI-generated content
Several Eduksha features rely on Google's Gemini API:
- Daily “Eduksha Times” news stories;
- Practice MCQs generated from a child's uploaded notes;
- Feedback on written answers.
Although we apply strict child-safety prompts and post-process the output, AI-generated content can occasionally be inaccurate or unexpected. Eduksha does not guarantee the correctness, completeness, or pedagogical accuracy of AI-generated answers, news, or feedback. Children and parents should treat it as supplementary, not as authoritative.
If you ever see content you believe is inappropriate, please report it to hello@eduksha.in and we will investigate within 72 hours.
6. Curriculum content
Eduksha references concepts, lesson titles, and topics aligned to the NCERT and CBSE curriculum. Eduksha is an independent product and is not affiliated with, endorsed by, or sponsored by NCERT, CBSE, or any government body. All curriculum trademarks belong to their respective owners.
7. Subscription and payments
The Service is currently offered free of charge during the launch phase. If we introduce paid features in the future, the pricing, billing cycle, and refund policy will be displayed inside the app before any charge is made, and your continued use will be subject to additional payment terms presented at that time.
8. Termination
You can stop using the Service at any time and delete your account from the Profile tab inside the app or by emailing us. We may suspend or terminate your access if you violate these Terms, if continued service would expose us to legal risk, or if Google removes the underlying infrastructure we depend on.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Eduksha disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Eduksha does not warrant that:
- The Service will be uninterrupted or error-free;
- Any AI-generated content will be accurate;
- Defects will be corrected on any particular timeline;
- The Service is suitable for a specific educational outcome.
10. Limitation of liability
To the fullest extent permitted by law, Eduksha and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim arising out of these Terms or the Service is limited to the amount you have paid us in the twelve months preceding the claim, or, if you have not paid anything, ₹1,000.
11. Indemnification
You agree to indemnify and hold Eduksha harmless from any claim, demand, or expense (including reasonable legal fees) arising from your or your child's use of the Service, your violation of these Terms, or your violation of any third-party right.
12. Governing law and jurisdiction
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. The courts of New Delhi, India will have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
13. Changes to these Terms
We may update these Terms when the Service evolves. The “Last updated” date at the top reflects the most recent revision. Material changes will be announced inside the app at least 14 days before they take effect. Your continued use after that period means you accept the updated Terms.

Eduksha
